Terms of Service

These Terms govern your use of Nightly Digest (the “Service”), an AI-curated reading digest. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Nightly Digest fetches publicly available articles from sources you choose or that we curate, ranks and summarizes them, and delivers a periodic digest by email and/or to your Kindle. Summaries are generated by third-party AI models and may contain errors; they are not a substitute for reading the original work, which we always link to.
2. Accounts
You sign in with a one-time email link. You are responsible for the security of your email account and for activity under your account. You must provide a valid email address and be at least 16 years old (or the age of digital consent in your country).
3. Acceptable use
You agree not to:
- use the Service to infringe copyright or other rights;
- resell or redistribute generated digests commercially without permission;
- attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the Service;
- add sources you are not permitted to access.
4. Third-party content
Source content remains the property of its publishers. We display short summaries and excerpts for personal, non-commercial reading and link to the original. If you are a publisher and want your content excluded, contact us and we will remove it promptly.
5. Subscriptions and billing
The Service offers a free tier and a paid “Pro” subscription. Payments are processed by Polar, our Merchant of Record, who handles billing and applicable taxes. Subscriptions renew automatically until cancelled. You can cancel any time from Settings or the billing portal; access continues until the end of the current period. Except where required by law, payments are non-refundable.
6. Cancellation and termination
You may stop using the Service and delete your account at any time from Settings. We may suspend or terminate accounts that violate these Terms or that bounce or complain repeatedly (to protect deliverability for everyone).
7. Disclaimers
The Service is provided “as is” without warranties of any kind. We do not warrant that summaries are accurate or complete, or that delivery is uninterrupted. AI output may be wrong — verify anything important against the source.
8. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential damages.
9. Changes
We may update these Terms. Material changes will be announced by email or in-app. Your continued use after changes take effect constitutes acceptance.
